Terms of Service
These terms and conditions apply to any and all equipment hire, transport services, or related solutions provided by North Shore Compact Hire Limited.
Collection & Delivery: For day hires, self-collection and drop-off must occur strictly between 7:00 AM and 7:00 PM, while weekly hires are restricted to collection from 7:00 AM on Monday until return by 7:00 PM on Friday. Late fees will apply. If North Shore Compact Hire is arranging transport, delivery and pick-up services to the site, this operational window is reduced by one hour on either side, operating exclusively between 8:00 AM and 6:00 PM. Hire fees are charged for the full day or week period, not the time it is actively used. No refunds, credits, or allowances will be given for inclement weather, site delays, or if the equipment remains idle.
Hire Period & Meter Limits: The hire starts when the equipment leaves the North Shore Compact Hire premises and ends when returned. Late returns will incur an additional late-return-fee of $100. Daily rates are calculated on a 24-hour period, allowing a maximum of 8 hours of engine operation meter time; weekly rates allow up to 40 hours of operation. Any engine operation hours exceeding these limits will be billed at an additional overage rate of $10 per hour.
Damage Waiver: A damage waiver of $35 per day is available. This covers "fair wear and tear" but does not cover negligence, tyre punctures, or use in prohibited areas (e.g., salt water). It further excludes theft due to a failure to lock or properly secure the equipment. Tyre and track damage, including punctures, tears, or excessive wear due to operation on jagged debris, is strictly excluded from the Damage Waiver. The Customer is 100% liable for the actual cost of tyre/track repair or replacement, plus any associated mobile tyre service call-out fees.
Fuel & Cleaning: Equipment is provided with a full tank of diesel and must be returned full. A $3.00/L refuelling fee and a $50.00 cleaning fee apply if the equipment is returned dirty or empty. Excessive mud, concrete, or paint contamination will incur supplementary cleaning charges of $50 per hour of cleaning required.
Safety & Operation: The Customer confirms they are competent to operate the machinery and warrants that they will strictly comply with all WorkSafe New Zealand health and safety guidelines, ensuring the equipment is operated safely by competent individuals using appropriate protective gear. North Shore Compact Hire is not liable for any injuries or property damage caused during the hire period.
Maintenance & Faults: North Shore Compact Hire warrants that the equipment is regularly maintained and supplied in safe working order. If the equipment develops a mechanical defect or error, the Customer must immediately cease use and contact North Shore Compact Hire. The Customer accepts all liability for any injury, loss, or property damage if the machinery is operated in a dangerous, reckless, or negligent manner. In the event of a mechanical breakdown not caused by Customer negligence, North Shore Compact Hire's liability is strictly limited to a pro-rata refund or credit of the hire fee for the duration the equipment was inoperable. North Shore Compact Hire is not liable for any consequential losses, lost profits, downtime, or third-party labour costs incurred by the Customer.
Location & Fair Use: The Customer agrees that all machinery must remain strictly at the declared job site or designated overnight address, and moving it without prior written consent is prohibited. The provided trailer is supplied exclusively for transporting North Shore Compact Hire machinery and must not be used for any other purpose or for third-party equipment. The Customer acknowledges that both the compact skid steer and trailer are GPS tracked, and any unauthorised movement or breach of these restrictions may incur additional penalty charges, asset recovery costs, or immediate termination of the hire agreement.
Security & Right of Entry: The Customer is responsible for the security of the machine. If stolen while in the Customer's possession, the Customer is liable for the full replacement cost. The Customer grants North Shore Compact Hire an irrevocable right to enter the property where the equipment is kept to inspect, maintain, or reclaim the gear. If North Shore Compact Hire must enter the property to recover the equipment after the contracted date and time, the Customer will be liable for a recovery fee up to $400.
Financials & Security Bond: Valid photo ID (NZ Driver’s License or Passport) must be provided before checkout. A security bond of $250 will be held on the Customer's card and adjusted/refunded within 7 working days post-hire, minus any metered overages, fuel, cleaning, or late return fees.
Damage & Expenses: The Customer agrees to be fully liable for all out-of-pocket expenses, legal fees, or recovery costs incurred by North Shore Compact Hire Limited due to any breach of these terms. The Customer authorises North Shore Compact Hire Limited to immediately deduct and recover these costs, penalties, or damages directly from the security bond or any provided payment method on file.
Ownership & Security Interest: The Equipment always remains the absolute property of Norths Shore Compact Hire Limited. The Customer has no right, title, or interest in the Equipment except as a bailee for the duration of the hire period. The Customer acknowledges that this agreement creates a security interest in the equipment under the Personal Property Securities Act 1999 (PPSA) and waives their right to receive a verification statement and agrees that North Shore Compact Hire may register its interest on the PPSR at the Customer's cost if required. The Customer must not sell, lease, charge, assign, or otherwise part with possession or create a competing security interest over the Equipment under any conditions.
Consumer Guarantees Act: Where the Customer acquires the hire services for the purposes of a business, the parties agree that the provisions of the Consumer Guarantees Act 1993 do not apply to the maximum extent permitted by law.
